Access to- and regular contact with your children both during and post-divorce is in integral part of the divorce proceedings.
It is of the utmost importance that the deed of settlement concluded during a divorce makes detailed provision for all rights and responsibilities in respect of minor children.
This process involves consultation with relevant professionals in ascertaining the best interests of the minor children when determining primary residence. We further assist with scheduling the relevant consultations at the Office of the Family Advocate as well as referral to Mediation, if so required.
We assist with the complex financial calculations, including the children’s monthly financial needs whilst taking into account the earning capabilities of both parents.
In the event that you are an unmarried parent, let us assist you with the compiling of a parenting plan, which regulates all rights and responsibilities in respect of your minor children. The parenting agreement, once agreed upon and signed, gets made an Order of Court, which, going forward, assists in enforcing the terms in case of default.
